Terms of Use

These Terms of Use ("Terms") govern your use of the Ownway mobile application and related services (together, the "Service") provided by Dvain Solutions ("we," "us," or "our"). By using the Service, you agree to these Terms.

1. What Ownway Does

Ownway is a route-planning service that interprets a trip description, searches for requested places, calculates route options, previews the result, and hands route coordinates or waypoints to supported navigation apps. Ownway is not a turn-by-turn navigation system, emergency service, traffic authority, travel agent, or booking service.

2. Eligibility

You may use the Service only if you can legally agree to these Terms. If you are below the age of majority where you live, you may use the Service only with permission from a parent or legal guardian.

3. Route and Safety Responsibilities

Routes, places, ratings, traffic information, travel times, opening information, road restrictions, and navigation handoffs may be incomplete, delayed, unavailable, or inaccurate. Conditions can change after a route is created. You are responsible for obeying laws, road signs, closures, access restrictions, vehicle limits, weather warnings, and instructions from authorities.

Review a trip before driving. Do not type, operate Ownway, or make route changes while driving. Use the supported navigation app and device controls safely. Never rely on Ownway for emergencies or situations where an incorrect route could cause injury, property damage, or other serious harm.

4. Third-Party Maps and Navigation

Ownway relies on third-party services including Apple, Google, OpenAI, Supabase, RevenueCat, Cloudflare, and Waze. When you open a trip in Apple Maps, Google Maps, or Waze, that service’s terms, privacy policy, availability, waypoint limits, and routing behavior apply. Waze may require Ownway to hand off a multi-stop trip one leg at a time. We do not control and are not responsible for third-party services, content, outages, or route decisions.

5. Permissions

Some features require optional permissions, including foreground location for route origins, microphone and speech recognition for voice input, notifications for reminders and Waze Companion, and background location for arrival detection during an active Waze Companion trip. You may decline or revoke permissions, but related features may not work.

6. Anonymous Identity and Acceptable Use

Ownway creates an anonymous service identity to authenticate requests, apply usage limits, and connect subscription access. You agree not to misuse the Service, bypass limits or payment controls, automate or resell access, scrape provider data, interfere with security, submit unlawful or harmful material, violate third-party rights, or use the Service in a way that creates unreasonable cost, load, or risk.

7. Free Access, Subscriptions, and Billing

Ownway may offer a limited number of route plans without charge and may offer paid auto-renewing subscriptions for expanded access. Current products, prices, billing periods, introductory offers, route allowances, and renewal terms are displayed before purchase. Usage allowances may reset periodically and are subject to reasonable abuse-prevention and service-capacity controls.

Purchases are processed by Apple and managed in your Apple Account. Unless canceled under Apple’s rules, a subscription renews automatically and Apple charges the payment method associated with your account. Manage or cancel through Apple’s subscription settings. Trials are available only when displayed and when Apple determines you are eligible. Refunds are handled by Apple under its policies. Deleting Ownway data or uninstalling the App does not cancel a subscription.

8. Changes and Availability

We may change route allowances, features, providers, eligibility, or the Service to maintain quality, security, legal compliance, and economic sustainability. We may suspend or discontinue all or part of the Service. Network access, supported providers, operating-system features, and provider capacity are required for core functionality.

9. Intellectual Property

Ownway’s software, branding, design, and original materials are owned by Dvain Solutions or its licensors and protected by law. Third-party maps, place information, ratings, route data, trademarks, and services belong to their respective owners. These Terms grant you a limited, personal, non-exclusive, non-transferable, revocable right to use Ownway for its intended purpose.

10. App Store Terms

If you obtain Ownway through Apple’s App Store, Apple is not a party to these Terms and is not responsible for maintaining or supporting Ownway except as required by law. Your license is also subject to Apple’s applicable usage rules and the Apple Standard End User License Agreement. If these Terms conflict with mandatory App Store terms, the applicable App Store terms control.

11. Disclaimer

To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind. We do not guarantee that a route will satisfy every preference, that a place will be suitable or available, that a provider will return accurate or complete information, or that the Service will be uninterrupted or error-free. Nothing in these Terms excludes rights or warranties that cannot legally be excluded.

12. Limitation of Liability

To the fullest extent permitted by law, Dvain Solutions and its providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of data, profits, opportunities, or goodwill, or losses arising from routes, road conditions, third-party services, navigation, or unsafe use. Our total liability for claims related to the Service will not exceed the amount you paid for Ownway during the twelve months before the event giving rise to the claim, except where applicable law requires otherwise.

13. Termination

You may stop using Ownway at any time. We may suspend or terminate access if you materially violate these Terms, create security or legal risk, abuse providers or usage limits, or if the Service is discontinued. Provisions that by their nature should survive termination will survive.

14. Privacy

15. Changes to These Terms

We may update these Terms. We will post the revised version here and update the effective date. Where required, we will provide additional notice. Continued use after revised Terms take effect means you accept them.
